Throughout the world, all societies function on one of two basic philosophical and political systems: collectivism or individualism. These two social systems are mutually exclusive; you cannot have both. You must choose one or the other.

In a society where the needs of the collective are more important than those of the individual, the State is charged with determining what is best for the collective, and empowered to regulate individual rights on behalf of collective needs. This inevitably leads to government corruption and oppression of the people so governed.

In the very early American Republic, our young state legislators and our young national congressmen did make the mistake of passing socialistic legislation on occasion, but these legal errors were definitely the exceptions rather than the rule. This podcast is the result of a several month long mock hearing conducted in the court of the American people and aired on The Voice of Freedom webcast, in which the petitioner, the people of the united States of America, asked that the UNITED STATES GOVERNMENT be ordered to show cause why the people should not immediately raise up arms against their government, and start a Second American Revolution.

During the mock hearing, evidence and testimony were presented by petitioner, showing numerous examples of murder of innocents by government agents, murder of soldiers and civilians and irreparable destruction of property in undeclared wars, disregard for the rule of law by judges, prosecutors lying and fabricating testimony in order to obtain indictments and convictions, and a general pattern of behavior by the government designed to undermine the very fabric of these united States of America and the American way of life.

The government arguments and responses to petitioner’s allegation were examined scrupulously and considered on their own merit. The hearing was conducted under general rules of evidence and testimony, but due to the exact nature of the mock hearings, it was impossible to adhere assiduously to precise court rules. The Points and Authorities for petitioner were cites taken directly from the Declaration of Independence. Its precepts about the purpose of government were used by the court to establish government’s proper role.

The judgment was rendered in as fair and open a manner as possible. It is my sincere wish that you will take this judgment not as a final statement on the issue, but rather as a beginning; a place from which to launch your own investigations, conduct your own hearings, and hopefully arrive at your own conclusions as to when and if to raise up arms against a government that has gone way too far down the road of tyranny; a road from which our Founding Fathers fought and died to protect us.

In the united States of America, the term firearms laws is actually and oxymoron, because the Second Amendment to the Constitution clearly states that the right to keep and bear arms shall not be infringed. That means that no law that in any way restricts, controls or otherwise attempts to limit the individual's use of any firearms, is invalid and legally unenforceable.

Of course, when a government attempts to force people to do something when it is specifically prohibited from doing so is a government engaged in usurpation, which is the legal justification for armed Revolution (see Declaration of Independence, 1776).

Your right to own and use firearms is a natural outgrowth of your fundamental right to life. God granted you the right to life, and He therefore gave you the right to defend your life, with whatever weapons you find necessary to accomplish that defense.
